I’ve run it this way. As long as you have the flag on the back.
Legal in Texas. It’s how I haul a lot of the times since it’s quicker and easier than me going above the cab.
This is a good setup. The only thing I’d change is just adding a bit of pool noodle zip tied to the horizontal bar to rest the kayak on. Make sure to use cam straps instead of ratchet straps and send it.

Add a strap across the top to avoid any bouncing and I’d say you’re good
